Terms and conditions of sale relating to sites, events, products and services marketed by Lem srl


Online sales are subject to the provisions of Legislative Decree no. 185 of 22 May 1999 "Implementation of Directive 97/7 / EC relating to the protection of consumers in respect of distance contracts"

1. Subjects. Service provider: LEM srl Piazza San Rocco 13 - 28921 Verbania (VB) - Italy - hereinafter LEM which may use for operational support in the management of orders and payments from external suppliers. For services provided by third parties LEM acts as an engine of booking and intermediary for the services provided and is not a party involved in the agreements between the guest and the service provider, and has no responsibility or implication towards the user regarding compliance with the terms of the contract. Terms and conditions of sale refer in any case to all types of ticket and / or service booked on the site, whether the service is provided directly by LEM or by other suppliers indicated on the site in the service description page. Customer: the person identified by the data entered at the time of the online purchase request and in this regard the guarantees referred to in the following article 6 are valid.

2. Object of the service. Booking service for live events and online products and services. The purchase is made by entering personal data online and paying by credit card (gateway stripe.com), PayPal - online bank transfer (Sofort). Payment by offline bank transfer can also be provided. Payment by bank transfer may not be active for particular promotions or close to the event itself.

The customer checks the availability of seats, products or services online, enters his data and his reservation and receives an email summarizing the data entered, with which he is asked to complete the payment. The confirmation of the reservation or purchase can be immediate or deferred. The reservation (or purchase) is confirmed only upon payment: the electronic booking ticket is created after payment has been made and automatically sent to the customer's email if payment is made by credit card or PayPal - in the case of payment by bank transfer the booking confirmation e-ticket is sent to the customer's email as soon as the amount is credited to the current account indicated by the supplier.

To be sure of the booking, it will therefore be necessary to wait for the confirmation email with the summary of the data, the number of the CONFIRMED booking and the BAR CODE of the booking ticket.

For online products or services, delivery may be deferred, for example for the time required for the creation of customized products.

If the customer does not proceed with the payment, the reservation will be canceled and the customer will receive an email communicating the cancellation and must therefore make a new reservation or purchase, if the seats or products and services are still available.


Once the booking has been confirmed, no refunds are made and no complaints will be accepted due to errors made by the Customer in the phase of entering and / or communicating data relating to the order. On the occasion of particular promotions specified on the site, "refundable" tickets can be activated: to obtain a refund it is necessary to document the objective inability to participate in the event by means of a medical certificate or other official documentation.


These additional refund guarantees can be purchased at the time of booking and provide for a deductible of € 2.50 per ticket.

In case of booking of live events (live), if the event is canceled due to regulatory provisions, ordinances or other (for example for health emergencies related to the Covid-19 epidemic) a voucher will be issued with a value equal to the reservation made, valid 365 days for all events organized directly by Lem srl - Vouchers cannot be used for activities or services managed by third parties, for example for catering, transport, rides or other.


By purchasing the flexible date option, to be made exclusively at the time of booking, the customer can change the booked date and time free of charge up to 8 days in advance. Just send an email to info@grottadibabbonatale.it choosing another date, among those currently available. In the case of dynamic price tickets, if with the change the cost of the ticket is higher, the customer will have to pay the difference, if the price is lower, there will be no refund of the price difference.

If no date is available, the customer can request a voucher for an amount equal to the value of the tickets purchased, valid for 365 days for all our events.

If the transfer request occurs between 8 and 3 days prior, the change can be made at a cost of € 5.00 per booking for digital products or services at a unit price (not per person) - if the change concerns events with booking and cost "per person" the change can be applied at a cost of € 3.00 per person. It is not possible to request a change to the booking date within 48 hours prior to the booked date.


In live events, the reservation must be presented at the BOOKED CASH DESK, appropriately indicated on the site with the indication CASSA PRENOTATI. The booking and purchase refers only to the Lem srl attractions specified on the site as included in the ticket, at the time of booking, on the date and time booked: any gifts and promotions reserved for ticket holders will be indicated on the site and not they are binding for the organization and are not to be understood as included in the ticket. If the customer forgets the electronic ticket on the day of the event, he can still communicate the booking number or his name, accompanied by an identity document, to the ticket office to search the service provider's databases. LEM is not responsible if due to the customer's forgetfulness it is not possible to trace the reservation number. At the time of presentation of the reservation at the reserved cashier and the delivery of the ticket, the check-in will be recorded in the system and the visitor will not be able to carry out subsequent check-ins with the same reservation as it has already been used. Replacement tickets or passes will not be delivered if the customer loses them once the booking has been delivered and the tickets have been collected.


To facilitate access to the areas of live events, the visitor can also make use of connection services, shuttles, trains, motorboats, buses, etc. managed by leading transport companies: LEM offers - if provided - the transport booking service, the provision of the service is under the responsibility of the transport company - At the sole discretion of the organization, the transport service may be canceled (due to force majeure, traffic problems, insufficient number of reservations, etc ...), subject to prior notice to the customer, with at least 48 hours notice. in this case the customer will have the right to withdraw from the booking with reimbursement of all expenses incurred for the live event, or he can request the booking to be moved, without any increase in costs. By accepting these conditions, the customer expressly relieves LEM from any and all liability and / or request for compensation as a result of damage to persons or property, accidents, misunderstandings, delays, missed connections, loss of objects following the use of the transport services booked and / or used, as well as for damage, injury or theft to persons, property, vehicles during the course of the event, in all areas with free access or restricted access to the possession of the ticket. With regard to the movements in the area of the event with the acceptance of this, the customer declares to be informed about the obligation to observe the highway code and expressly relieves LEM from any and all liability and / or request for compensation as a result of damage. to people or things, accidents, loss of objects and any other inconvenience that may occur in the public or private areas affected by the event and in the related structures. Any medical aid, recovery, hospitalization, first aid, medication, hospitalization or other interventions, if not covered by the NHS, are entirely the responsibility of the customer. If the event involves the presence of animals, the customer declares himself informed that it is forbidden to approach, touch or feed the animals and expressly relieves LEM from any and all liability. Managers and contact persons for the keeping and management of the animal area are indicated on site.


By accepting these conditions, the buyer also expressly declares that the participation of any minors will only take place under the supervision and responsibility of the parents, guardians or responsible accompanying persons. LEM is in no case responsible for the services provided by third parties present in the live events, catering services, commercial areas and related commercial points, transport by tourist train, attractions and amusement parks and any and all activities, animation, demonstration, laboratory, show not expressly attributable to the attractions managed by LEM. These services are not included in the ticket and will eventually be purchased directly by the customer from the respective suppliers. When filling in forms, webforms, questionnaires, surveys, gaming or other, LEM may randomly and at its sole discretion give users discounts, products or services, not aimed at encouraging the purchase or objects of minimal value. For gaming activities LEM will make use of specific platforms prepared for this purpose, both for registration and participation, and for drawing and winning, without direct control of the drawing or winning activities which will therefore be completely random and entrusted to electronic modalities.


3. Prices. Unless otherwise indicated in writing, all prices indicated are "VAT included", where due. An additional cost of € 1.50 per ticket is applied to online tickets that also include a live part. In the case of dynamic price tickets, the cost of the ticket may vary according to the booking date, the date booked, the time slot, the number of people booked.

4. Payment. Payment is made by credit card (Visa, Mastercard, PostePay or Carta Aura) through Stripe's online payment gateway with 128-bit encryption system, Stripe-Sofort or via PayPal. The payment gateway is managed by Stripe .com (or PayPal). LEM is not aware of the customer's credit card number.The Customer is informed that the online payment is completed only after, following the Customer's confirmation of the order, the Electronic Money Institute (IME) gives consent to use of the credit card. In case of payment by bank transfer, the payment is considered completed only after the transfer has been credited to the Supplier's account. The customer can anticipate a copy of the bank transfer by e-mail (lemsegreteria@gmail.com) or by fax to 0323-497349 - highlighting the CRO number. The organizer and the supplier respond directly to the customer for compliance of the service provided with what is illustrated in the service description page. 5. Gifts: online booking may include gifts that are recognized to the customer by the organization or by third parties. In events where the free photo is provided, it cannot be combined: therefore it is not possible to request more photographs that represent the same subjects, or for groups of people in which even just one subject has already been portrayed in other free photographs or for bookings attributable to the same person, whether the same person uses the same name, with different emails, or different names with different emails, but entered from the same PC, unequivocally identified at the time of booking by automatically registering the user's IP. Therefore, if a single reservation is artificially divided into several reservations for the purposes of the gift, the reservations identified by the same IP will be considered unequivocally a single reservation. The largest user groups will be entitled to one free photo for every 8 people. The free photo is excluded for bookings of a single person. The participants of our events can also be granted discount vouchers, to encourage and promote the purchase of services or activities managed directly by Lem srl or by third parties: on these third-party activities Lem srl has no direct responsibility for liability, compulsory tariffs or other types of constraints that must be followed by whoever provides the services purchased at a discounted price by Lem srl customers. 6. Right of withdrawal. The discipline of withdrawal provided for in art. 64-67 of Legislative Decree 206/2005 (so-called Consumer Code) relating to the rules for the protection of consumers in the event of contracts negotiated away from business premises or stipulated at a distance, is excluded for Proposals concerning services relating to 'accommodation, transport, catering and leisure pursuant to art. 55 of the same decree: "Art. 55. Exclusions 1. The right of withdrawal provided for in articles 64 and following, as well as articles 52 and 53 and paragraph 1 of article 54 do not apply: (omissis) b) to contracts of provision of services relating to accommodation, transport, catering, leisure, when at the time of the conclusion of the contract the professional undertakes to provide these services on a specific date or in a predetermined period. "

Live events will take place in any weather conditions: for reasons of force majeure, explicit prescriptions by public authorities and / or surveillance and control or particular adverse weather conditions and at the sole discretion of the organization, the location of the event may also be moved without notice elsewhere, always in the same location, in order to allow the program to run. The booking times for live admissions, where provided, may vary due to the influx of visitors or other organizational or logistical reasons: in the event of delays, the organization undertakes to extend the entrances to the event beyond the established time, so as to allow everyone to access the visit. However, if a date is still canceled by the organizers due to force majeure - other than cancellation for health reasons related to the Covid epidemic (in this case, as specified above, the fee paid for the live part of the events will be refunded by voucher) - to customer will be issued a voucher equal to the amount paid for the live event, to book the visit on another date, for other events organized by LEM srl or for the next edition, if there are no dates available or the customer opts for such solution.

7. Guarantees given by the Customer. The Customer guarantees, assuming all inherent responsibility and holding LEM harmless, as an intermediary, from any prejudicial consequence, that their data, provided upon acceptance of these general conditions, are true and allow to identify the true identity of the Customer. himself who also undertakes to immediately inform the Supplier in writing, including by e-mail, of any variation of the data provided. 8. Limitation of Liability.
